Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "User," or "You") and SRP Auto Group ("Company," "We," "Us"). By accessing our website or engaging our auto brokering services, you agree to these Terms.

1. Nature of Services (Auto Broker Disclosure)

SRP Auto Group is a licensed Auto Broker in the State of California.

• We are not a Dealership: We do not own the inventory we locate for you. We act as an agent to arrange the transaction between you and a selling dealership.
• We are not a Lender: We do not provide financing. We assist in submitting your credit application to third-party lenders.
• Fee Disclosure: If you are charged a brokering fee directly by us, this fee is for our locating and negotiating services. It is separate from the price of the vehicle unless otherwise structured in the final contract.

2. User Obligations

By using our services, you represent and warrant that:

• You are at least 18 years of age and possess the legal authority to enter into a binding contract.
• All information you provide (identity, income, employment) is accurate, current, and truthful. Providing false information for a credit application is a crime.
• You authorize SRP Auto Group to communicate with dealerships and lenders on your behalf.

3. Credit Application and Inquiry

By submitting a request for a vehicle lease or purchase that requires financing, you explicitly authorize SRP Auto Group and its dealer partners to:

• Obtain your consumer credit report from one or more credit reporting agencies (Equifax, Experian, TransUnion).
• Share this information with prospective lenders to secure financing approval.

You acknowledge that these inquiries may impact your credit score.

4. Vehicle Availability and Pricing

• Estimates Only: All quotes provided via email, phone, or website are estimates based on current market conditions, anticipated residuals, money factors, and incentives.
• Subject to Change: Final pricing is contingent upon credit approval (tier 1 credit is usually required for advertised rates) and dealer inventory availability at the time of signing.
• No Guarantee: We cannot guarantee the availability of a specific vehicle until a deposit has been placed or a contract has been signed with the selling dealership.

5. Fees and Cancellation

• Broker Fee: Any broker fee payable to SRP Auto Group will be disclosed in writing prior to the execution of services.
• Retainers: If a retainer fee is required to begin the vehicle search, the terms regarding the refundability of that retainer will be outlined in a separate Broker Agreement.
• Cancellation: You may cancel your request at any time before signing the vehicle contract. However, any non-refundable retainers paid to SRP Auto Group for work already performed may be forfeited.

6. Limitation of Liability

To the fullest extent permitted by California law:

• Indirect Damages: SRP Auto Group shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services.
• Vehicle Condition: We make no warranties, express or implied, regarding the condition, merchantability, or fitness for a particular purpose of any vehicle. All warranties are provided solely by the manufacturer or the selling dealership.
• Maximum Liability: In no event shall our total liability to you exceed the amount of fees, if any, you have paid directly to SRP Auto Group in the six (6) months prior to the claim.

7. Indemnification

You agree to defend, indemnify, and hold harmless SRP Auto Group, its officers, directors, and employees from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.

8. Governing Law and Dispute Resolution

• Governing Law: These Terms shall be governed by the laws of the State of California.
• Venue: Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in the County of San Diego.
• Arbitration: At our sole discretion, we may require you to submit any disputes arising from the use of these Terms or the Website to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying California law.
